By accessing or using Paak, the sports club management platform operated by Emmara, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Paak is a software-as-a-service (SaaS) platform designed to help sports clubs and associations manage their members, payments, teams, and administrative tasks. The service is provided "as is" and may be updated from time to time.

3. Account Registration

To use Paak, you must:

  • Register for an account with accurate information
  • Be at least 18 years old or have parental consent
  • Keep your login credentials secure
  • Notify us immediately of any unauthorized account access

4. Acceptable Use

You agree not to:

  • Use the service for any illegal purpose
  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Attempt to gain unauthorized access to our systems
  • Use the service to store or transmit malicious code
  • Interfere with the service's operation

5. Data Responsibility

As a club administrator using Paak, you are responsible for:

  • Obtaining appropriate consent from your members
  • Ensuring the accuracy of data entered
  • Complying with applicable data protection laws
  • Managing access permissions within your organization

6. Pricing and Payment

Pricing is as displayed on our website at the time of purchase. We reserve the right to change prices with 30 days notice. Payments are processed securely through Mollie. Refunds are provided according to our refund policy.

7. Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • Access continues until the end of your billing period
  • You can export your data before account closure
  • Data will be deleted within 90 days of account closure

8. Intellectual Property

Paak, including its design, features, and content, is owned by Emmara. You retain ownership of the data you input into the platform. We grant you a limited, non-exclusive license to use the service for its intended purpose.

9. Limitation of Liability

To the maximum extent permitted by law, Emmara shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of Paak. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. We are not liable for interruptions beyond our control.

11. Changes to Terms

We may modify these Terms of Service at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

12. Governing Law

These terms are governed by French law. Any disputes shall be resolved in the courts of France.
